COUNCIL ACTION

AGENDA ITEM:
Consider authorizing the City Manager to negotiate and execute an agreement for the purchase and installation of playground equipment with Whirlix Design, Inc. in the amount of $750,000 and approving a Resolution authorizing the City Manager to advance the City's Playground Renovation Project account with $750,000 from the General Fund to be reimbursed from proceeds of future Certificates of Obligation as provided for in the City's FY 2022 Budget and in accordance with Internal Revenue Service requirements
BACKGROUND:
The Parks and Recreation Department and Purchasing Division hosted a pre-bid meeting on February 18, 2021 for PKR-2103-RFP to identify a qualified vendor for the design and installation of playground equipment for the City's park system. On March 16, five sealed bids were received and publicly opened. The bidding companies included: GameTime, Whirlix Design Inc, Child Play Inc, PTI Sports and Recreation, and Lea Park and Play.
 
Proposals were evaluated by the Parks Department. Staff evaluated their proposals and scheduled interviews in an attempt to select a contractor for the project. The evaluation criteria included the firm's relevant experience, project management approach, and project design history and success. As a result of the interviews, staff recommended that the City consider entering into a contract for design and construction of playgrounds with Whirlix Design Inc. for the sum of $750,000.
FINDINGS:
The Parks & Recreation Department is also requesting a reimbursement resolution to begin this project. The reimbursement resolution identifies the City's intent to reimburse the General Fund with proceeds received from a future debt issuance in order to comply with Internal Revenue Service (IRS) requirements for the use of future tax-exempt debt instruments. The project is scheduled to be completed in Fall 2022.
FINANCIAL IMPACT:
The funding for this project will come from the Park Improvement Fund through the use of proceeds from the planned FY 2022 bond sale. This purchase is included in the FY 2022 Adopted Budget.
RECOMMENDATION:
Staff recommends that the City Council authorize the City Manager to negotiate and execute an agreement for the purchase and installation of playground equipment with Whirlix Design, Inc. in the amount of $750,000 and approving a Resolution authorizing the City Manager to advance the City's Playground Renovation Project account with $750,000 from the General Fund to be reimbursed from proceeds of future Certificates of Obligation as provided for in the City's FY 2022 Budget and in accordance with Internal Revenue Service requirements
