AGENDA ITEM:
Conduct a Public Hearing and consider an Ordinance for a Zoning Case Z-1450-21 with zoning of General Retail (GR) to allow for a Safety Training school by a Special Use Permit-297 (SUP-297). The property is located on 511 S. Interstate 35 E and consists of 4.52 acres. Applicant: Robert J. Guinee Jr. and Property Owner: Sylvia Sanchez
SUMMARY:
The applicant is proposing a 15,574 square foot building for a safety training school on property with zoning General Retail (GR). The property is generally located at the northwest corner of Interstate 35 and East Parkerville Road as shown on the vicinity map. As shown on the aerial exhibit, the property is currently vacant. The Concept Plan attached to this staff report shows access from Interstate 35.
 
The Zoning exhibit shows the property is currently zoned General Retail (GR). Current zoning for the surrounding properties is:
  • North: General Retail (GR)
  • East: City Limits
  • South: General Retail (GR)
  • West: Planned Development-127 (PD-127)
The City defines a Commercial Trade School as “a business organized to operate for a profit and offering instruction and training in a trade such as welding, brick laying, machinery operation, and similar trades.” This is the closest Use Definition per the City Zoning Ordinance to allow for the proposed safety training school. The Commercial Trade School in the General Retail (GR) zoning district is allowed by a Specific Use Permit (SUP). 
 
The applicant has indicated all training will be conducted indoors. ESC Safety Consultants provide inspections, performance reports, new hire orientation, network services, training, and review/write safety programs. This facility will be used as a training facility for numerous classes including but not limited to CPR and First Aid, Trenching & Excavation, Electrical Safety, Lockout/Tagout, Fall Protection, Forklifts, Aerial or Scissor Lifts, Confined Space, Steel Erection, Rigging Techniques, Crane Awareness, Scaffold Safety, HazMat, and OSHA compliance.
PUBLICATION REQUIREMENTS:
Staff notified property owners within 200 feet and published the “Notice of Public Hearing” as required by law. Five (5) notices were mailed to adjoining property owners. One (1) reply was received in opposition and one (1) reply was received in favor.
RECOMMENDATION:
The Comprehensive Plan displays the subject area as Office/Retail and states “This land use is suitable for establishments providing merchandise for retail sale, including a daycare, shopping center, restaurant or bars, grocery store, souvenir shops, etc. It also includes professional or corporate office, medical or doctor’s office, administrative offices such as real estate, insurance, or banking.”

The applicant is proposing a new 15,574 square foot building for a safety training school. This facility will be used as a training facility for numerous classes including but not limited to CPR and First Aid, Trenching & Excavation, Electrical Safety, Lockout/Tagout, Fall Protection, Forklifts, Aerial or Scissor Lifts, Confined Space, Steel Erection, Rigging Techniques, Crane Awareness, Scaffold Safety, HazMat, and OSHA compliance.
 
Staff recommends approval of the request as the proposed development is adjacent to Interstate 35 and aligns with uses recommended in the Comprehensive Plan such as professional, corporate, or administrative offices.

Planning and Zoning Commission Recommendation: 
The Planning and Zoning Commission considered this request at their September 14, 2021 meeting and unanimously voted to approve Special Use Permit - 297 (SUP-297) as presented. 
COUNCIL ACTION
Motion by Mayor Pro Tem Byrd with a second by Councilmember Hughes to approve as presented. Motion passes 4-3.
