COUNCIL ACTION
AGENDA ITEM:
Consider authorizing the City Manager to negotiate and execute Amendment No. 4 to the agreement for professional services with Freese and Nichols, Inc. in an amount not to exceed $86,216.50 for the Westmoreland Road expansion project. 
BACKGROUND:
Staff continues the work to deliver the Westmoreland Road project, a one-mile long expansion project between the Parkerville Road to Belt Line Road. This improvement is a joint project with Dallas County, with the County contributing $3,000,000 toward project costs. The City is the lead agency for project delivery. 

The project scope includes widening Westmoreland Road to a four-lane concrete street with two lanes in each direction separated by a raised median. Drainage improvements, sidewalks, street lighting, landscaping, and traffic signals at the Eagle Drive and Parkerville Road intersections will also be included. 

Design is 95% complete. The effort to acquire the private property needed to accommodate the proposed public improvements is on-going. Staff continues to coordinate with franchise utility companies to relocate utility assets that are in conflict with the proposed public improvements. There is an existing 30" Dallas Water Utility (DWU) transmission line within the Westmoreland right of way. The proposed design impacts the current locaton of the water line and requires that the water line be lowered to avoid infrastructure conflicts.  

Construction for the City's improvements is estimated to begin in Summer 2022. 
FINDINGS:
On November 21, 2017, City Council authorized execution of an Agreement for Professional Services with Freese and Nichols, Inc. to perform project design services in a not-to-exceed amount of $1,061,500. On December 19, 2018, Amendment No. 1 in the amount of $16,659 was authorized for additional services to support design. On May 19, 2020, Council approved Amendment No. 2 for $126,900 for additional necessary design services not included in the original scope. On May 18, 2021, Council approved Amendment No. 3 for utility relocation monitoring and coordination services not included in the original scope. 

Staff requested a scope and fee proposal from Freese and Nichols, Inc. for developing construction plans and specifications for Dallas Water Utilities (DWU) owned or operated water main replacements, relocations, and/or appurtenance adjustments necessary to clear proposed paving, drainage, or other improvements for City of DeSoto on S Westmoreland Road, representing Amendment No. 4 to the Agreement for Professional Services.  
FINANCIAL IMPACT:
The not-to-exceed amount for Amendment No. 4 is $86,216.50. Funds are available in Fund 490 (Street Infrastructure Improvements). 
RECOMMENDATION:
Staff recommends that the City Council authorize the City Manager to negotiate and execute Amendment No. 4 to the agreement for professional services with Freese and Nichols, Inc. in an amount not to exceed $86,216.50 for the Westmoreland Road expansion project.
