A Public Hearing request to Rezone property by Mitchell & Associates, Inc., representing Manning Homes, Inc. for Liberty Star, Phase 3 from B-5 (Commercial Services District) to R-2 (Two-Family Residential District) being a portion of Coryell County Property ID: 153818, located south of Risen Star Lane, north of U.S. Highway 190, Copperas Cove, TX. Bobby Lewis, Development Services Director
BACKGROUND/HISTORY
On October 28, 2021, staff received an application from Mitchell & Associates, Inc. representing Manning Homes, Inc. for Liberty Star, Phase 3 to rezone property from B-5 (Commercial Services District) to R-2 (Two-Family Residential District) for a portion of the property known as Lot 1, Block 1, Liberty Star, Phase 2, consisting of 5.883 acres, City of Copperas Cove, per recording No. 322179, Plat Records of Coryell County, otherwise known as Coryell County Property ID: 153818, located south of Risen Star Lane, north of U.S. Highway 190 Copperas Cove, TX.

On November 2, 2021, staff held a Plat and Plan review for Liberty Star, Phase 3 being planned for sixteen (16) residential duplex units on eight (8) lots, consisting of 1.425 acres, more or less.  After the meeting, staff provided the applicant with several comments that are attached to this staff report.

On November 15, 2021, staff received a letter in response to comments from the applicant's representative, which is attached to this staff report.
FINDINGS/CURRENT ACTIVITY
Comprehensive Plan:
As previously noted, the City’s Comprehensive Plan and Future Land Use Plan (FLUP) map for this development shows this property to be designated as Retail (Retail & Commercial).  Please find the vicinity maps attached to this staff report.

Land Use Compatibility:
The current amendment to MD (Medium Density Residential) will be consistent with the FLUP map together with the proposed rezoning to R-2 (Two-Family Residential District) for the proposed duplex units on this property.

Access:
The proposed development will have primary access along Risen Star Lane.

Code of Ordinances, Chapter 20-15(a)(10)b states the following:
“Presentation of proposals.  The commission or board shall call, or cause to be called by the secretary, each proposal or request in such order as to be in accord with the hearing time specified in the notice of public hearing.
 
The chairman shall next call on the staff for a factual summary and presentation relative to the proposal, request or appeal and shall afford the staff an opportunity to call to the attention to the commission or board any additional pertinent communications.

The chairman shall then call on persons present who wish to speak concerning the proposal, request or appeal and shall direct that they speak in the following order:

1. Applicant or his representative;
2. Those persons in support of said matter; and,
3. Those persons in opposition to the matter.

When necessary, the chairman shall direct that all remarks shall be germane to the proposal, request or appeal.  No rebuttal shall be permitted by either side; however, the Commission or board may direct questions to any speaker in order to clarify statements and facts presented.

Then the chairman shall declare the public hearing or presentation closed as to that proposal, request, or appeal.”

Consideration:
In consideration of the rezoning request by Manning Homes, Inc., the Commission may take any of the following actions:

1. Recommend approval of the rezoning.
2. Recommend denial of the rezoning, citing the reasons for the recommendation.
3. Recommend a less intense zoning classification, citing the reasons for the recommendation.
ACTION OPTIONS/RECOMMENDATION
Staff recommends the Planning & Zoning Commission make the determination to recommend approval to City Council as requested.
