A Public Hearing request to amend the Future Land Use Plan map by Mitchell & Associates, Inc., representing Manning Homes, Inc. for Liberty Star, Phase 3 from Retail (Retail and Commercial) to MD (Medium Density Residential) being a portion of Coryell County Property ID: 153818, located south of Risen Star Lane, north of U.S. Highway 190 Copperas Cove, TX. BACKGROUND/HISTORY
On October 28, 2021, staff received an application from Mitchell & Associates, Inc. representing Manning Homes, Inc. for Liberty Star, Phase 3 to amend the Future Land Use Plan map from Retail (Retail & Commercial) to MD (Medium Density Residential) for a portion of the property known as Lot 1, Block 1, Liberty Star, Phase 2, consisting of 5.883 acres, City of Copperas Cove, per recording No. 322179, Plat Records of Coryell County, otherwise known as Coryell County Property ID: 153818, located south of Risen Star Lane, north of U.S. Highway 190 Copperas Cove, TX.

On November 2, 2021, staff held a Plat and Plan review for Liberty Star, Phase 3 being planned for sixteen (16) residential duplex units on eight (8) lots, consisting of 1.425 acres, more or less.  After the meeting, staff provided the applicant with several comments that are attached to this staff report.

On November 15, 2021, staff received a letter in response to comments from the applicant's representative, which is attached to this staff report. 
FINDINGS/CURRENT ACTIVITY
Currently, the Future Land Use Plan map shows this property designated as Retail (Retail & Commercial).  The adjacent property to the east is an existing drainage facility owned by the City of Copperas Cove and is designated Public.  The adjacent properties to the north and west are designated LD (Low Density Residential).

The request to amend the Future Land Use Plan map to MD (Medium Density Residential) will accommodate the applicant’s future development plans for constructing duplex residential units and is compatible with the adjacent residential land use designations in the area.

In order to assist the Planning and Zoning Commission with making a recommendation to City Council, a set of guidance questions is provided as follows:

1. Will the proposed change enhance the property and the surrounding area?
2. Is the proposed change a better use than that recommended by the Future Land Use Plan?
3. Will the proposed use impact adjacent residential areas in a negative manner?  Alternatively, will the proposed use be compatible with, and/or enhance, adjacent residential areas?
4. Are uses adjacent to the proposed use similar in nature in terms of being harmonious and consistent with one another, and with other general aspects of compatibility?
5. Does the proposed use present a significant benefit to the public health, safety, and welfare of the community?  Would it contribute to the City’s long-term economic well-being?

Staff finds the applicant does satisfy the above guidance questions of the Future Land Use Plan amendment from Retail (Retail & Commercial) to MD (Medium Density Residential) land use designation for the purpose of constructing residential duplex homes in the near future.
ACTION OPTIONS/RECOMMENDATION
Staff recommends the Planning & Zoning Commission make the necessary findings and recommend approval to City Council as requested.
