TITLE:    Public Hearing and Resolution Relating to Petitions for Reduction of Arterial Construction Fee Assessments

RECOMMENDATION
Staff recommends City Council conduct a public hearing and approve the proposed resolution reducing the Arterial Construction Fee assessments for the two hundred twenty-eight (228) parcels meeting the criteria of Ordinance 21-5768. 
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
The City Council adopted Ordinance 21-5768 on August 9, 2021, which allows Commercially zoned, Residential Manufactured Home (RMH) zoned and Mixed Residential zoned property owners to petition for a reduced arterial construction fee assessment if the property is used solely as an owner-occupied, single family residence.  The relief for these properties caps the parcel square footage at 9,600 square feet and calculates the assessment based on the lower neighborhood zoning classification rate instead of the property's assigned zoning classification rate.  The Public Works Department received two hundred sixty-one (261) signed petitions involving two hundred sixty-one (261) parcels.  Two hundred twenty-eight (228) parcels met the criteria specified in Ordinance 21-5768 and qualify for a reduction of the Arterial Construction Fee Assessment. Thirty-three (33) parcels did not meet the criteria. Of these thirty-three (33) parcels, twenty-two (22) parcels are not eligible because the parcels are zoned in a classification that is not eligible to petition for a reduction in the assessment, five (5) parcels are not single family residences, and six (6) parcels are not owner occupied.
ALTERNATIVES
City Council may:
  • Approve the resolution reducing the Arterial Construction Fee assessments for the two hundred twenty-eight (228) parcels meeting the criteria of Ordinance 21-5768 ; or,
  • Not approve the resolution if the Council finds that the properties do not meet the criteria.
FISCAL EFFECTS
The reduction in Arterial Construction Fee assessments for FY22 is $12,466.80. The impacted property owners will realize varying reductions in their assessments with the average reduction amount of $54.68.
