SUBJECT:
Approve transition of City Manager Larry Rains from contract to regular City employment.
RECOMMENDATION:
It is recommended the Mayor and Council approve the transition of City Manager Larry Rains from the current contract to regular City employment status effective April 11, 2021, with compensation set at pay Range 104, Step 7, and including the normal benefit package for the City Manager position.
DISCUSSION:
In February 2020, the Mayor and Council accepted the retirement notice of City Manager Larry Rains, and approved his continued employment under a contract with a third party (initially Smartworks Plus and subsequently with ESI after ESI purchased Smartworks).  Arizona State Retirement System rules allow an ASRS retiree to return to regular service with an ASRS employer after at least one year has elapsed since the retirement date, without impacting the earned retirement benefits.  Mr. Rains' official retirement date was March 20, 2020.  His annual performance evaluation was conducted at the March 15, 2021, Council meeting.
FISCAL IMPACT:
Adequate funds have been included in the FY20/21 City Manager Department budget to handle the increased costs for pay and benefits resulting from the recommended action for the balance of the fiscal year.
ALTERNATIVES:
Take some other action regarding the City Manager's employment status.
