Effluent Use Agreement - Consider recommending approval of a form agreement for effluent use. (Stubbs/Sanchez)
BACKGROUND:
Initiated by: Lorenzo Sanchez
The City sells treated effluent water from the WWTP to surrounding farms and other private properties. Sale of effluent provides a benefit to the City by reducing the amount discharged into the Hondo River, thereby decreasing the need for sampling, testing and reporting.
The proposed agreement, if approved, will provide a standard template for use with all customers purchasing effluent from the WWTP.
FINANCIAL CONSIDERATION
Customers will pay the City $6.25 per acre feet for a predetermined amount of effluent and $7.50 per acre feet for effluent beyond the predetermined amount. Rates are subject to annual CPI or 3% increase. Rates are further subject to increase at the City’s discretion upon 30 days notice.
LEGAL REVIEW:
The City Attorney drafted the proposed form agreement.
Contracts must generally be approved by a majority of a quorum of the Governing Body.
BOARD AND COMMITTEE ACTION:
The Legal Committee recommended (3-0) approval at their meeting on April 29, 2021.
STAFF RECOMMENDATION:
Effluent Use Agreement - Consider recommending approval of a form agreement for effluent use.
