Receive, consider and act upon a License Agreement for Parking Facilities with Brazos Transit District for the Research Forest Park and Ride;
Entering into a parking license agreement with Brazos Transit District is economically beneficial to the Township as it provides approximately 1,000 parking spaces for users of the Township's new sports complex under development, with no capital expense. Using a cost to construct new parking at $1,962.33 per parking space (cost per space for the Bear Branch Sportsfield parking lot expansion) 1,000 spaces would translate to a cost of $1,962,330, assuming land for this number of spaces could be acquired or planned on the Gosling sportsfield site. There are operational expenses related to the license agreement, which include the opening and closing of gates between the facilities daily. The current unit price per the Custodial/Gate Agreement is $4.75 per day or $1,733 per year.

The current concept plan provides for a parking lot on the Township's site accommodating 45 spaces with an estimated cost of $90,000.
The Woodlands was developed, in part, with the concept of shared parking for its parks and recreation facilities and associated community facilities. Examples of this are the various agreements the Township  has executed with Interfaith of The Woodlands (Ridgewood and Falconwing Parks), and Faith Bible Church for shared parking. While there are 45 parking spaces included in the current concept plan of the Gosling Sportsfields, more parking is required to satisfy the demand during peak times for practices, games and tournaments. The Gosling site was chosen for sportsfield development in part due to the potential to use the Park and Ride to fill the demand for parking.

Legal counsel developed the License  Agreement for Parking Facilities (Attachment A), which outlines various rights and responsibilities of each party. The term of the agreement is 20 years, which will automatically renew for another 20 years. The Township will have access to the additional parking at the following times and be responsible for opening/closing of gates, installing way finding signs, and as needed waste disposal:
• Weekdays (Monday – Friday): 5:00 p.m. to 11:30 p.m.;
• Weekend Days (Saturday – Sunday): 6:00 a.m. to 11:30 p.m.; and
• Such additional times as the Parties may mutually agree.

Brazos Transit District has not reviewed or approved the agreement. Staff and legal counsel do not expect there to be any major issues of concern as the District has verbally agreed to the concept.
It is recommended to approve the License Agreement for Parking Facilities with the Brazos Transit District and, as long as the agreement is not substantially altered after review by the District and is satisfactory to Township legal counsel, authorize the President/General Manager to execute the agreement.
