SUBJECT MATTER:
Receive, consider and act upon assignment of a contract for park and ride commuter bus services from the Brazos Transit District to The Woodlands Township;

BACKGROUND:
In  2013,  The Woodlands Township entered into an Interlocal agreement with the Brazos Transit District regarding the operation of the Woodlands park and ride facilities.  The 2013 Interlocal agreement provided that Brazos would continue to provide the operation and maintenance services of the park and ride facilities using existing FTA grant funds which were allocated in 2010 and prior,  State Transit funds and user fees to support the operation and maintenance costs of the park and rides as well as the contract cost of the bus operator.   This agreement specified that once these old FTA funds were exhausted,  the Township would assume the financial responsibility for the park and ride operations.  BTD notified the Township in January, 2015, that they had used all of the 2010 and prior FTA grant funds there were available for funding operations and that The Township could assume financial operations for the park and ride operation beginning January 1, 2015.
 
 

There are two component parts associated with the park and ride operations. Brazos uses First Class Tours to provide the commuter bus services. First Class Tours provides the buses and all costs associated with the vehicle operation and bills for these services monthly.  Brazos Transit provides for the operation, maintenance and management of the park and ride facilities and will bill the Township monthly.   The assumption of park and ride financial responsibilities requires that the Township assume the bus operator contract with First Class Tours and the operation and maintenance agreement  with Brazos.   Attached is an assignment agreement which allows the Township to assume the First Class Tours contract for the period January 1, 2015 to April 30, 2015.   The Township recently authorized a new five year contract with First Class Tours effective April 30, 2015.   A second agreement on your agenda (Letter of Understanding) deals with the Brazos services.
RECOMMENDATION:
Authorize the President / General Manager to execute the contract assignment of commuter bus services commencing January 1, 2015.
