SUBJECT MATTER:
Receive, consider and act upon a funding request from Bayou Land Conservancy regarding trails in the Spring Creek Greenway and George Mitchell Nature Preserve;
FISCAL IMPACT:
The Board of Directors approved an allocation of $25,000 in the 2014 budget for funding the match portion of a Texas Parks and Wildlife Grant to Greater Houston Off Road Bicycle Association (GHORBA) for the development of trails in the George Mitchell Nature Preserve.

Bayou Land Conservancy has been assigned the grant from GHORBA and requested additional funding from the Board in the amount of $30,000 ($20,000 to perform a wetland delineation survey and $10,000 to perform an archaeological survey) for the development of the trail system.  Total request is $55,000.
BACKGROUND:
Jennifer Lorenz, Executive Director of the Bayou Land Conservancy (BLC), provided an update to the Board at the October 16th meeting on the Spring Creek Greenway project, their Ambassador program and the development of trails in the Spring Creek Greenway including those in the George Mitchell Nature Preserve, and wetland delineation issues. BLC indicated they have received approval from Texas Parks and Wildlife to assume the grant awarded to GHORBA.
 
Ms. Lorenz requested additional funding from the Board in the amount of $30,000 ($20,000 to perform a wetland delineation survey and $10,000 to perform an archaeological survey) for the development of the trail system.

Following the presentation the Board asked for clarification on several issues and tabled the item until clarification can be provided.
  • Which portions of the Greenway/ tracts have actual conservation easements imposed upon them and dedicated to BLC ;
  • Which portions of the Greenway tracts are in the process of having conservation easements imposed upon them;
  • Are there any tracts that may be owned by Montgomery County, Harris County, The Woodlands Development Company or other private property owners that BLC has access or use rights granted or in the process of having access rights granted – as opposed to conservation easements;
  • Provide documentation of the Memorandum of Agreement between GHORBA and BLC along with approval of the transfer from Texas Parks and Wildlife;
  • Provide proof of financial ability to fund the trail development project prior to grant reimbursement.
BLC has provided responses and related documentation to clarify the issues and Ms. Lorenz will be present at the December 11th meeting to provide the Board an updated presentation.

RECOMMENDATION:
Approve funding in the amount of $25,000 for the matching portion of the Texas Parks and Wildlife Grant for the development of trails in the George Mitchell Nature Preserve and Spring Creek Greenway, conditioned upon the transfer of the grant from GHORBA to Bayou Land Conservancy evidenced by the execution of the TPW Local Grant Agreement, and authorize the President/General Manager to execute any agreements necessary related to the Township’s funding per legal counsel’s review and approval.
