SUBJECT MATTER:
Receive, consider and act upon calling a Directors Election to be held on November 4, 2014 and determining the procedure of giving notice of same (refer to Supplemental Agenda);

BACKGROUND:
The enabling legislation for the Township requires that an election be called annually for the May uniform election date for the election by position of either 3 or 4 directors, as appropriate, based upon the staggered terms for each of the director positions. As permitted by the Texas Election Code, the Township took action in 2012 to move its director elections to the November uniform election date. Per the Election Code, the Township is required to adopt an order calling the election on or before Monday, August 18, 2014, and to specify the manner in which notice of the election will be given. Schwartz, Page & Harding, L.L.P. has prepared the attached order calling the November 4, 2014, Director Election, which contemplates joint participation with both Montgomery and Harris Counties in their respective elections. Please note that certain information in the draft order (and exhibits to be attached thereto) as to polling locations, precincts, election officials, and type of electronic voting equipment will be completed once that information is finalized and made available by each County.

The Texas Election Code also requires that the Board appoint an agent for the Township for the November election. Consistent with past practice, staff recommends that the President/General Manager be appointed as the Township’s Election Agent for such election. Appointment is accomplished by adoption of the Order Calling Directors Election.

At its meeting of July 17, 2014, the Board took action to approve a Joint Election Agreement and Election Services Agreement with Montgomery County and an Election Agreement with Harris County. Pursuant to those agreements, Montgomery County and Harris County will perform certain early voting period and Election Day services for all entities participating in the joint election, including the hiring and payment of election officials.
RECOMMENDATION:
Staff recommends adoption of the attached form of Order Calling Directors Election which, consistent with past practice, specifies that notice of the election will be given by posting, and designates the President/General Manager as the Township’s Election Agent.
