SUBJECT MATTER:
Receive, consider and act upon amendments to Township Orders 019-09 and 020-09 regarding Incidental Use of the Park and Ride facilities and related fees;
FISCAL IMPACT:
There is potential to realize additional revenue to the park and ride operations from permit fees with little to no additional expense.  The amount of new revenue is unknown but anticipated to be minimal. The proposed Amendment to Order 020-09 establishes the following fees which are similar to the fees to use Town Green Park and Rob Fleming Park:
  1. Facility Fee
    1. Non-profit organizations = $500 flat fee for the first six hours and $100 per hour thereafter
    2. Commercial organizations = $2,000 per day ( 6:00 a.m. to 11:00 p.m.) 
  2. Permit Fee
    1. Non-profit organizations = $500
    2. Commercial organizations = $1,000
  3. Cleaning Fee = $50 per hour to clean the facility to its original condition
Damage Fee = the actual cost to repair the damage plus an additional 15%
BACKGROUND:
Pursuant to the public hearing conducted on this matter, the Board of Directors may take action on the proposed amendments to Orders 019-09 & 020-09 as is presented herein.

The Township receives requests from outside organizations to use the Park and Ride facilities for overflow parking and for hosting events.  These requests have not been approved administratively as 1) there is no existing Order, policy or guideline established by the Board; and 2) there is no real capacity at the Sawdust and Research Forest locations to allow additional use. The Board of Directors has approved a lease with ORWALL for parking at the Sawdust Park and Ride and approved the use of the Research Forest  Park and Ride for the adjacent sports field parking, therefore there is little opportunity for additional use during the off-hours at these two facilities. However, there are no current after hours / weekend agreements for the use of the Sterling Ridge Park and Ride lot. Therefore, it is recommended to amend Township Orders 019-09 and 020-09 to allow the use of this facility, (that would also apply to the other two facilities if capacity does become available),  for  activities on weekends such as overflow parking and commercial uses and to establish rental rates similar to rates charged for the use of other Township facilities such as Town Green Park. 

The Federal Transit Administration allows Incidental Use of federally funded  facilities, (within the guidelines established by FTA Circular 5010iE).  Therefore amendments have been drafted to Township Orders 019-09 & 020-09 (Attachments A & B) to provide for the Incidental Use of the Township's three Park and Ride Facilities and to establish related fees.  The Amendments as drafted cover all three park and ride facilities, so that in the event the Sawdust or Research Forest facilities come available for Incidental Use, the ability to issue permits is provided in the Orders. 

The amendment to Order 019-09  adds Park and Ride Facilities to paragraph i. in Section 2. G. Specific Use Facilities and new paragraphs:
  1. Specific Use Facilities (Dog Friendly Areas, Wheel Friendly Areas / Skate Parks, Disc Golf Courses, Swimming Pools, Community Gardens, All Weather Fields, Park and Ride facilities, etc.) may have additional rules and regulations that are posted inside or in the vicinity of each facility.  The President or his designee shall have the authority to prescribe such rules and regulations for Specific Use Facilities as deemed necessary, provided that said rules are consistent with industry standards and are in compliance with health and safety regulations.  It shall be unlawful for any person to violate any posted rules for Specific Use Facilities.
vi.The Woodlands Township shall permit Incidental Use of the three Park and Ride facilities the Township operates during the transit system’s non-revenue service hours with the following intended purposes: the temporary use of the parking spaces that encourages non-transit uses of the facilities that can raise additional revenue for the transit system or, at a reasonable cost, enhance system ridership; the temporary use of parking spaces by adjacent businesses and restaurants; temporary use of parking spaces for staging areas for construction projects; temporary use of parking spaces and terminals for special events created for the enjoyment of the community.  Any Incidental Use of the facilities shall not interfere with the intended use of the facilities or the Township’s ability to maintain satisfactory continuing control, or reduce the facilities’ transit capacities.   Fees for permits or licenses to use the facilities shall be established by Order 020-09.

vii. The following rules shall apply:
  1. No parking for longer than 48 hours without prior approval
  2. Unapproved parking is subject to tow at owner’s expense
  3. No solicitation is allowed
  4. Incidental Use is allowed by Permit
viii. The President / General Manager of The Woodlands Township shall have the authority to prescribe written Procedures for the administration of and use of the Park and Ride facilities, provided such Procedures do not conflict with this Order or any valid and applicable law, ordinance or U.S. Department of Transportation or Federal Transit Administration regulation. 
The Amendment to Order 019-09  provides the President/General Manager the authority to prescribe written Procedures for the administration of and use of the Park and Ride Facilities,  Upon approval of the amendments to the Orders, Procedures will be developed that will include but not be limited to security and insurance requirements, limits on use and restrictions on amplified sound.  


The amendment to Order 020-09 Section 2. Reservation Fees adds paragraph 2.17 as follows:

2.17 Park and Ride Facilities
2.17.1  Facility Fee

RECOMMENDATION:
Adopt the amendments to Orders 019-09 & 020-09 as presented.
