SUBJECT MATTER:
Receive, consider and act upon a presentation on the San Jacinto River Authority Budget and proposed rate increase and related matters regarding the Groundwater Reduction Plan contracts;
FISCAL IMPACT:
The Township has no authority over water rates, but is a high volume user for the purposes of Township community maintenance and operations.
BACKGROUND:
At the April 26 Township Board meeting, Director Brown requested that a May Board agenda include a presentation regarding the San Jacinto River Authority (SJRA) budget and the corresponding water user rate that is scheduled to take effect on September 1, 2017. This budget and rate includes the financial impact of the ongoing litigation between the SJRA and two area municipalities. While the Township has no direct authority over water, water distribution or water use fees, and is not a party to a GRP agreement, this matter is very pertinent in that it impacts all water users in The Woodlands MUDs, including the Township governmental organization. The projected need for the 14 cent increase in the SJRA water rates (per 1,000 gallons used) is attributed directly to the SJRA’s increased cost of litigation and the unpaid/underpaid accounts of two large municipal users.
 
This item has been scheduled for the May 24 agenda and Mr. Mark Smith with the SJRA will make the presentation.     
 
Chairman Bunch requested as part of this agenda item that interested parties to the SJRA litigation matter be provided an opportunity to present to the Township Board. Invitations were sent to the following entities to allow these entities to provide a presentation of no more than 5 minutes each on this matter at the Township Board meeting on May 24.
  • Quadvest
  • City of Conroe
  • WJPA on behalf of the MUDs and their elected Boards
  • SJRA

Since this matter is still the subject of ongoing litigation, it is unknown what level of discussion may be appropriate or desirable, but each of the groups can confer with their legal counsel to determine if they want to make a presentation and determine the content to be included in the presentation. 
RECOMMENDATION:
Receive and accept the report.
