SUBJECT MATTER:
Receive, consider and act upon conveyance of Village of Creekside Park Sec. 32, ROSR “A” – Liberty Square Park; and, Creekside Park Village Park Restricted Reserve “A” – Wendtwood Park Phase II;
FISCAL IMPACT:
Base annual maintenance cost for Liberty Square Park and for Phase II of Wendtwoods Park is estimated to be $14,816, which will be added to the master park maintenance service agreement with Bio Landscape, Inc. Construction cost for Liberty Square Park was approximately $625,000, and a portion of the total cost of Wendtwoods Park ($3,000,000) was allocated to Phase II of the park. Phase I was accepted by the Board in May 2013. These costs were shared with The Woodlands Land Development Company (TWLDC) and The Woodlands Township- 50%-50% per the terms of the Recreation Facilities Development Agreement.
BACKGROUND:
The Woodlands Land Development Company(TWLDC) has submitted Creekside Park Section 33- ROSR A- Liberty Square Park and Creekside Park West Restricted Reserve A for conveyance (Attachments A & B). Both parcels are located in the Village of Creekside Park. Liberty Square is located in the New Harmony area, is 1.551 acres and contains the standard neighborhood park amenity package  but without a playground. A playground for the area is located a tenth of a mile to the west at Rockwell Park. This is the 130th park in the community’s park system. The conveyance of the remaining portion of Wentwoods Park, Phase II,  is 7.152 acres and includes a multipurpose field with lights and the playground for the park.

These parks have been inspected and  pre-conveyance reports have been provided to TWLDC (Attachments C & D). While no major issues were reported, it is recommended to authorize the acceptance of conveyance upon the completion of the issues identifed in the pre-conveyance inspection reports.  Legal counsel has completed a review of the Special Warranty Deeds and find them to be acceptable.
RECOMMENDATION:
Upon the completion of the issues identified in the pre-conveyance inspection reports as presented, accept the conveyances by Special Warranty Deeds from The Woodlands Land Development Company, L.P. for Creekside Park Section 32, ROSR A - Liberty Square Park, and Creekside Park West Restricted Reserve A - Wentwoods Park Phase II.
