SUBJECT MATTER:
Receive, consider and act upon a conveyance of Village of Creekside Park Section 38, Reserve A; Section 39, Reserves A,C, D & E; Section 40, Reserves A & B; and related fences, alleys and associated improvements;
FISCAL IMPACT:
Base annual maintenance cost adding the reserves  is estimated to be $3,066. Several of the reserves that are included for conveyance are a component of the streetscape program.  Initially, limited maintenance is required on the alley ways, however long term (30-40 years) costs maybe necessary to renovate or replace the concrete. Dollars for routine maintenance have been included in the 2016 Parks Operations and/or the Streetscape budgets.
BACKGROUND:
The Woodlands Land Development Company (TWLDC) has submitted the following reserves for conveyance: Creekside Park Section 38, Reserve A and Alley; Section 39, Reserves A, C, D, &  E, Alley and Fence Easement;  and Section 40, Reserves  A &  B, Alley and Fence Easement (Attachments A & B).  Overall, it is not uncommon for alleyways to be conveyed to the Township.  The Township  has accepted alleyways in other areas such as the Montfair & Bonny Branch neighborhoods of the Village of Sterling Ridge and Cottage Green neighborhood in the Village of Alden Bridge ). The ROSR’s have been inspected and a pre-conveyance report has been provided to TWLDC. No major issues were reported.  Township Attorney has completed a review of the Special Warranty Deeds and has found them to be acceptable. 
 
RECOMMENDATION:
Accept the conveyance by Special Warranty Deed from The Woodlands Land Development Company, L.P. for Creekside Park Section 38 Reserve A and Alley; Section 39, Reserves A, C, D, & E, Alley and Fence Easement; and Section 40, Reserve  Section A &  B, Alley and Fence Easement.
