Receive, consider and act upon acceptance of a pathway easement in the Village of Grogan's Mill;
Annual maintenance is estimated to be $100 for base pathway maintenance. These costs will be added to the master agreement of Bio Landscape, Inc.
The Woodlands Land Development Company has submitted for conveyance a pathway easement for conveyance to the Township (Attachment A). The pathway crosses underneath Grogan's Mill Road and connects the Grogan's Mill Village Center and surrounding area to the community pathway system.
This section of pathway has been in existence for many years and heavily used by residents. The section of pathway was found to be still owned by The Woodlands Development Company and never conveyed to the Association or Township. The pathway has been closed for over a year for necessary repairs and to rebuild the pathway structure. Now that the repairs have been completed, The Woodlands Development Company is submitting the section of pathway for conveyance to the Township by way of a pathway easement. Pathway easements are the typical instrument used for public access on pathways on commercial tracts of property. Legal counsel has completed a review of the Pathway Easement and has found it to be acceptable.
Accept the Pathway Easement for the pathway underneath Grogan's Mill Rd. from The Woodlands Land Development Company, L.P. and authorize the President/General Manager to execute the easement.
