SUBJECT MATTER:
Receive, consider and act upon the conveyances of the Village of Creekside Park: Section 24, ROSR's A,C, & D; Section 25, ROSR's A & D; Section 27, ROSR's A & B; Section 28, ROSR's A, B, C & D; Section 29, ROSR's B & C; Section 31, ROSR's A & C;
FISCAL IMPACT:
Annual maintenance cost for the submitted Restricted Open Space Reserves (ROSR's) will be $2,534 as provided through an addition to  the Park and Pathway Maintenance Service Agreement with Bio Landscape, Inc. Annual maintenance costs for the ROSRs, without pathways or improvements, is limited to as-needed hazard tree removal and drainage remediation. The reserves with pathways, approximately 2,157 linear feet, are estimated to cost $60.78 per year to maintain. One section of the pathway system will be maintained as part of the streetscape program and one reserve contains a large grass area that will be maintained to Tier D standards. 
BACKGROUND:
The Woodlands Land Development Company (TWLDC)  has submitted the following Restricted Open Space Reserves for conveyance by Special Warranty Deeds: Creekside Park: Section 24, ROSR's A, C & D; Section 25, ROSR's A & D; Section 27, ROSR's A and B; Section 28, ROSR's A, B, C & D; Section 29, ROSR's B & C, Section 31, ROSR's A & C (Attachment A - Special Warranty Deeds). The ROSR's have been inspected and a pre-conveyance report has been provided to TWLDC. No major issues were reported. Legal counsel has completed a review of the Special Warranty Deeds and has found them to be acceptable.
RECOMMENDATION:
Accept the conveyances by Special Warranty Deeds from The Woodlands Land Development Company L.P. for the Village of Creekside Park: Section 24, ROSR's A,C, & D; Section 25, ROSR's A & D; Section 27, ROSR's A & B; Section 28, ROSR's A, B, C & D; Section 29, ROSR's B & C; Section 31, ROSR's A & C.
