|The Woodlands Township staff has been working with Commissioner Noack’s Office to finalize a lease agreement for the Sawdust Park and Ride facility. On October 28, 2015, the Township Board approved the proposed lease agreement (attached) and the proposed lease was submitted to the County Attorney's Office. After discussion regarding this matter, the Commissioner wants to assure that the Park and Ride lease will include a provision to allow adjacent athletic field users to use this facility when not required for park and ride purposes. To clearly allow for this use, the draft October 28th agreement is proposed to be amended to include one additional provision which states the following:
“Notwithstanding anything herein to the contrary, Landlord acknowledges that Tenant intends to enter into certain parking agreements with third parties for said third parties’ use of the parking areas on the Premises (“Parking Agreements”). So long as the Parking Agreements do not substantially interfere with Tenant’s operation of the Facilities, Landlord’s consent shall not be required for said Parking Agreements and such Parking Agreements shall not be considered a sublease or assignment as provided for in this Article 12. Tenant shall notify Landlord in writing within ten (10) business days after the full execution of any Parking Agreement”.
Township staff intends to bring a parking agreement to the Township Board at the February or March meeting to allow site parking at the Sawdust Park and Ride facility by adjacent sports field users (during non operating park and ride hours) The parking agreement is anticipated to be very similar to the agreement that the Township currently has with the Brazos Transit District (BTD) that allows athletic field users (at the Gosling Sports Park) to park at the Research Park and Ride facility.
Based on recent correspondence, we believe that the Commissioner’s Court will consider this agreement at their first meeting in February.
