SUBJECT MATTER:
Receive, consider and act upon the conveyance of reserves in Creekside Park West Section 16- Restricted Reserve A and a portion of Restricted Reserve C of Section 18 Creekside Park West;
FISCAL IMPACT:
Base annual maintenance cost related to these reserves will be  minimal as one reserve will be maintained through the existing streetscape program and the other, a neighborhood entrance, will be maintained by the Timarron HOA through the MOA approved by the Board of Directors in November 2015.
 
BACKGROUND:
The Woodlands Land Development Company (TWLDC) has submitted the following Restricted Reserves for conveyance: Creekside Park West Section 16 - Restricted Reserve A, consisting of a 1.745 acre parcel and a 0.2243 acre parcel;  and a .2646 acre portion of Creekside Park West Section 18 Restricted Reserve C (Attachments A & B).  The two small acre parcels make up the neighborhood entrance of Timarron Lakes.   The Township Board of Directors approved a Memorandum of Agreement in November that establishes that the Timarron Lakes HOA will maintain the landscape of the entry.  The ROSR’s have been inspected and a pre-conveyance report has been provided to TWLDC. No major issues were reported.  Legal counsel has completed a review of the Special Warranty Deeds and found them to be acceptable. 
 
RECOMMENDATION:
Accept the conveyance by Special Warranty Deed from The Woodlands Land Development Company, L.P. for Creekside Park West Section 16, Restricted Reserve A and a 0.2646 acre portion of Restricted Reserve C Creekside Park West Section 18.
