|The original expanded boundaries of Town Center Improvement District of Montgomery County, Texas (now The Woodlands Township) were established by adoption of an order on August 29, 2007. At that time, a comprehensive metes and bounds description of the boundaries and a boundary map were prepared to assist in the November, 2007 election to confirm the expansion of the boundaries of the Township. Subsequently, by Order No. 014-07, adopted on November 16, 2007, the Board dissolved the four previously existing economic development zones in the TCID and created a new consolidated zone called The Woodlands Township Economic Development Zone having the same boundaries as the Township.
On July 28, 2010, the Township Board of Directors considered a petition requesting the annexation of five (5) additional, small tracts of land to the Township and to the EDZ boundaries and adopted an order annexing those tracts. The City of Houston had previously approved the First Amendment to the Regional Participation Agreement consenting to the annexation of these tracts and two additional tracts. The two additional tracts were pending purchase by TWLDC at the time of the hearing, but were not then closed, so they were not included in the annexations. No revised boundary map was prepared reflecting these boundary additions.
On December 11, 2014, the Township Board of Directors considered five (5) petitions requesting the annexation of nine (9) additional, small tracts of land to the Township and to the EDZ boundaries and adopted Order No. 018-14 annexing those tracts. The City of Houston had previously approved the Second Amendment to the Regional Participation Agreement consenting to the annexation of these tracts and one additional tract. The owner of the one additional tract did not submit a petition for annexation, so this tract was not annexed. At that time, TWLDC had since closed on the purchase of the two small tracts omitted from the 2010 annexation but had overlooked submitting a petition for their annexation. No revised boundary map was prepared reflecting these boundary additions. No other annexations or boundary adjustments have been made to the Township since 2007.
TWLDC then submitted an annexation petition for the two tracts not included in the 2010 annexation. At its November 18, 2015h meeting, the Township Board Order 016-15 approved this annexation petition, adding two tracts (totaling approximately 12.7 acres) planned for single family residential development. These two tracts are completely surrounded by other residential lands within the Township boundaries in the far southwest portion of the Village of Creekside Park.
An updated boundary description and map of the Township was also prepared, so as to have an up to date boundary and map going forward. This included a cross check with all of the MUD boundary maps to confirm that there is no land within any MUD that is not also within the Township (although there are several small parcels within the Township that are not, for a variety of reasons, within any MUD). In the process of examining the updated boundaries, it was noted that the orders annexing land to the Township did not specifically address the addition of these annexed lands into the EDZ, as requested by the petitions. While it appears that the boundaries of the EDZ are expanded automatically by the addition of land to the Township or by operation of law, the Township Board Order 017-15 also ratified and confirmed the addition of the annexed lands to the boundaries of the EDZ and redefining the boundaries of the EDZ to match the boundaries of the Township.
