Discussion and Direction to Staff Regarding Possible Disposal of Town Property on La Paloma and Above the Town Shop -

The Town owns property on La Paloma between Mariposa Drive and Cucaracha Street. There are three parcels, 505-32-032B, 505-32-032D and 505-32-033. It is zoned R1-6 and has some floodprone area. It is approximately 78,750 square feet of vacant land.
At the November 4, 2019 Town Council meeting, Council directed staff to consider sale of the property if it was possible to stipulate that the buyers would use the property for workforce housing, veterans, teachers and first responders. The attorney reviewed Council's stipulations and advised that there are some legal obstacles in structuring the bid process as Council directed. There are state statutes and case law governing how the Town can sell real property. It is not impossible to structure a sale with stipulations to accomplish Council's goals, but any such sale would require additional direction from Council and, from a practical stance, might just result in no bids due to the topographical issues with the parcel.
The Town also owns property above the Public Services shop that could be parceled off to be a sellable lot on top of the hill off of Chaparral Road.
