In HB 2, the Cannabis Regulation Act, codified as NMSA 1978, § 26-2C-1 et seq., the New Mexico Legislature established a comprehensive regulatory framework for the possession, cultivation, manufacture and sales of cannabis and cannabis-derived products under state law. The Act allows local jurisdictions to adopt time, place and manner rules consistent with the Cannabis Regulation Act, including rules that reasonably limit density of licenses and operating times consistent with neighborhood uses.
Proposed Ordinance 21-09 would create and establish a framework for a new chapter 27 of the City Code relating to cannabis regulations. The initial provisions will address personal use and possession and zoning of cannabis establishments within the City. Subsequent additions are contemplated to address comprehensively all aspects of cannabis falling within municipal jurisdiction.
