a.   9/4/18 Regular Meeting Minutes
4.   CORRESPONDENCE AND/OR COMMUNICATIONS FROM THE MAYOR:
a.   Mayor's request for Council's approval to appoint former Lorain Port Authority Board member, Neil R. Sommers, to fill the vacancy created by Connie Carr's departure. 
5.   CORRESPONDENCE FROM DIRECTORS, BOARDS, COMMISSIONS, ETC.:
a.   Planning Commission's recommendation dated 9/5/2018 for the rezoning of property located on Arizona Avenue from R-PUD to I-1 Light Industrial with special land use to allow for storage facilities. Ronald Cocco, applicant. 
6.   CORRESPONDENCE FROM OTHER GOVERNMENTAL AGENCIES:
a.   OH EPA Public Notice 18-09-012 regarding the NPDES permit for a variance from water-quality based limits for US Steel Tubular Operations & 2199 E. 28 St. Lorain, OH.   Comments accepted on draft modifcation for 30 days from public notice date. 
b.   OH Dept of Liquor Control's notification of an application for a New D1, D2, D3 permit application for Harbortown Provisions CO, LTD dba Uniontown Provisions @ 422 Broadway. 
c.   Ohio Dept of Liquor Control's notification of an application for a New C1 permit application for Oberlin Food Fair Corp @ 4375 Oberlin Ave.
d.   OH Dept. of Liquor Control's notif of a D1, D2, D3 & D6, transfer permit application from Castillo Real Inc. to J. Humberto & Melgoza Perez, Patio and Deck @ 2532 W. Erie Avenue, 1st Floor. 
7.   CORRESPONDENCE FROM THE GENERAL PUBLIC:
a.   Email correspondence from Kathryn Kennedy requesting an opportunity to speak (5-10 min) regariding a poverty elimination program she wishes to replicate within the City of Lorain and then eventually the remainder of the county. 
b.   Charter Communications letter dated 8/14/18, detailing the submission of their quarterly franchise fee payment totaling $166,712.22. 
8.   COMMITTEE REPORTS:  None
9.   LEGISLATION - FIRST READING:
a.   ____ Reso. supporting and welcoming the 3rd Annual "FireFish Festival" Downtown Lorain on September 21 & 22, 2018.
b.   ____ Reso. amending Reso. 27-18, Section 1 & 5 by deleting ODOT and inserting "NOACA" as the correct funding agency. 
c.   ____ Reso. amending Reso. 1-18, Rule 10, Section 3 - Standing Committies, to incorporate the add'l responsibilities of the "Audit Committee" into the Finance & Claims Committee, as recommended in the 2017 year-end Audit. 
d.   ____Ord. authorizing the S/S Dir. to enter into a contract for the hauling and disposal of liquid sludge and filter cake from two (2) WPC plants for a period of two (2) years w/optional one (1) year extensions. 
e.   ____Ord. authorizing the Safety/Service Director to adv. for bids/enter into a contract for the purchase of water meters/meter equip. for use by the Utility Dept. for a one-year period w/optional one year extensions. 
f.   ____Ord. authorizing the S/S Director to enter into contracts for the purchase of supplies for use by the Utilities Dept. 
g.   ____Ord. approve the Chief of Police, through the Mayor, to accept the award of the 2019 Impaired Driving Enforcement Program and selected Traffic enforcement grants through the OH Dept. of Public Safety for $35,103.54. *(A motion to amend by substituting with the revised ordinance is required.)
h.   ____Ord. repealing the existing Chapter 303- Enforcement, Impounding and Penalties, and establishing new Cod. Ord. Section Chapter 303 - Enforcement, Impounding and Penalties. 
i.   ____Appropriation
j.   **Motion to waive the 72-hour rule and add the following item to the agenda for consideration.
____Ord. authorizing the Safety/Service Director to adv. for bids for the sale of real property (700 Broadway) no longer needed for municipal purposes.

11.   LEGISLATION - THIRD READING:  None
12.   COMMITTEE CALLS: 
  • The Building/Lands & All Council Committee was rescheduled to Monday, Sept. 24, 2018 @ 6 p.m to hear a presentation from OHM Consultants on the City's Comprehensive Land Use plan.
  • The Parks & Recreation Committee meeting has also been rescheduled to Monday, Oct. 22, 2018 @ 6 p.m. to discuss a possible smoking ban on city-owned property. 
  • A Public Hearing will be held on Monday, Oct. 15, 2018 @ 5:30 p.m. to discuss the application to rezone 3 parcels  located on Arizona Ave. from R-PUD to I-1 Light Industrial - Special Land Use w/conditions to allow for storage units.  
13.   MISCELLANEOUS CONCERNS FROM COUNCIL:

"AN EXECUTIVE SESSION, BY PROPER MOTION, WILL BE HELD IN ACCORDANCE WITH O.R.C. 121.22 G (3) TO CONFERENCE WITH THE PUBLIC BODY'S ATTORNEY REGARDING DISPUTES THAT ARE THE SUBJECT OF PENDING AND/OR IMMINENT COURT ACTION.
