Consider Zoning Case Z-1343-17; a change in zoning from Planned Development-42 (PD-42) to Office-2 (O-2); and an Amendment to the Comprehensive Plan changing the designation of this area on the Future Land Use Map from Mixed Use- Residential to Office/Retail; an area on Barrows Place and to the west of Hampton Road; consisting of 8 lots and 4.28 acres.  Applicant: Josh Millsap; Owner: City of DeSoto.
A Skilled Nursing Facility is planned for the area in question.  Since this area is currently within a Planned Development, the applicant would like to rezone this property to Office-2, which will allow for the Skilled Nursing Facility.

The property in question consists of eight (8) lots on Barrows Place, which is located to the west of Hampton Road, as provided on the Vicinity Map.

As provided on the Zoning Exhibit, the property in question is currently zoned Planned Development-42 (PD-42), which is a Planned Development for Office uses. To the north and south is Single Family-9 (SF-9) zoning, to the west, across the creek, is Single Family-9 (SF-9) zoning and Planned Development-109 (PD-109), which is a Single Family Planned Development.  To the east is a small area of General Retail (GR), and with General Retail (GR), Multi-Family (MF) and Single Family-9 (SF-9) to the east of Hampton Road.

As seen on the Aerial Photo, the property in question consists of six (6) vacant lots, with a building on an additional lot and then storage on the adjoining lot, which are located to the south of Barrows Place.  To the north and west, across the creek, are single family homes.  To the southeast is an office building and south of that is a large lot with a home adjoining Hampton Road, with the west part of the lot being vacant.  Just to the east is a vacant lot with a restaurant to the east of that.  Further to the east, across Hampton Road, is an apartment complex and a small retail center.  To the east of that are single family homes.

As stated above, the property in question is within a Planned Development that consists of several individual lots for office development.  This change in zoning would remove  this Planned Development, for the lots in question, and replace it with Office-2 (O-2) zoning.  In so doing, a Skilled Nursing Facility consisting of approximately 100 beds will be allowed to be constructed on this site.

The Future Land Use Plan denotes the property in question for Mixed Use Residential (MU-R).  As part of this case, this designation will change to Office/Retail if this zoning is approved.
Staff published "Notice of Public Hearing" and notified property owners within 200 feet, as required by law. Seventeen (17) notices were mailed to adjoining property owners, zero (0) replies were received in favor and zero (0) replies were received in opposition.
