County  of  Burnet       {}             On this the 6th day of February, 2019, the Burnet County Commissioners Court met in Special Session.  The following members of the court were present:

Agenda
  1.  Call to Order
 
2.  Public Comments.  Any person with business before the Commissioners’ Court not scheduled on the agenda may speak to the Court. No formal action can be taken on these items at this meeting. Comments regarding specific agenda items should occur when the item is called.  There is a 2 minute speaking limit. 
 
3.   Discussion and/or action concerning the appointments to the community and economic development committee per LGC 381.004 (Oakley)
 
4.  Discussion and/or action regarding the request from J.P. #1 to purchase a Varidesk for their Chief Deputy Clerk, to be paid out of the J.P. #1 technology fund (Nelson)
 
5.  Discussion and/or action regarding J.P. #4 requesting for her Chief Deputy to attend the Tyler Connect Conference.  The cost of the conference is $1,981.70, to be paid out of the technology fund (Bindseil)

Call to Order
  James Oakley, County Judge, called the meeting to order at 9:00 AM.

Item #3:
Appointments to Development Committees
  The court discussed  the appointments to the community and economic development committee per LGC 381.004.

James Oakley, County Judge, stated that the development of this committee is required by Local Government Code to administer the funds that are associated with unclaimed capital credits. These capital credits have been issued, but were never claimed by their intended recipients and are then returned to the State Comptroller's Office. Once these funds go back to the Comptroller's Office, Burnet County is able to make application for a percentage of the funds. Before Burnet County can expend these funds, a committee must be formed. The expenditures must follow the same guidelines as the Tourism Tax. These funds can be used for Economic Development, Tourism, Historic Preservation, Education, and Economic Growth. This committee will comprise three members. Judge Oakley recommends the Committee comprises himself, Karen Hardin, and Damon Beierle.
  Motion was made by Commissioner Precinct 3 Billy Wall, Seconded by: Commissioner Precinct 1 Jim Luther, Jr. to approve the Community and Economic Development Committee.
  Vote: 5 - 0 - Unanimously
             
Item #4:
JP1 Varidesk
  The court discussed  the request from J.P. #1 to purchase a Varidesk for their Chief Deputy Clerk, to be paid out of the J.P. #1 technology fund. Roxanne Nelson, Justice of the Peace Precinct 1, amended her request to have the funds come from her department's Time Payment Fund as opposed to the Technology Fund as originally requested. The amount requested is $495.00.
  Vote: 5 - 0 - Unanimously
  Motion was made by Commissioner Precinct 1 Jim Luther, Jr., Seconded by: Commissioner Precinct 3 Billy Wall to approve the request from J.P. #1 to purchase a Varidesk for their Chief Deputy Clerk, to be paid out of the J.P. #1 Time Payment Fund as amended by Judge Nelson. The amount required for the desk is $495.00.

Item #5:
JP4 Tyler Conference
  The court discussed J.P. #4 requesting for her Chief Deputy to attend the Tyler Connect Conference.  The cost of the conference is $1,981.70, to be paid out of the technology fund.

Item #6:
TxDOT Roadway Classification
  The court discussed the functional classification of various roadways by TxDOT.

James Oakley, County Judge, and Greg Haley, Burnet County's technical advisor with CAMPO, presented the intention of TxDOT to downgrade a section of Highway 29 from a Principal Arterial/Other Highway to a Minor Arterial Highway. The section is between US 281 and RR 2341. TxDOT also intends to add a portion of Highway 29, from US 183 to SH 130, to the National Highway System. Burnet County would like to formally voice their opposition to the downgrading of the portion of this highway from US 281 to RR 2341.
  Motion was made by Commissioner Precinct 3 Billy Wall, Seconded by: Commissioner Precinct 1 Jim Luther, Jr. to approve adding Highway 29 from US 183 to SH 130 to the National Highway System, and to formally object to downgrading the portion of Highway 29 between US 281 to RR 2341 to a Minor Arterial Roadway.

Departmental Updates
  The court heard departmental updates.

The Auditor's Office welcomed a new Auditor, Karin Smith.

James Oakley, County Judge, informed the court there would be a Lodger's Workshop held at the Agrilife Building on 2-25-2019 at 9:00 AM.

Karen Harden, County Services Director, stated there would be another Media Tour March 25-28, 2019.
             
Item #8:
Acknowledgement of Receipt
  James Oakley, County  Judge, stated that the court could expect to review the Membership Dues Request for the South Texas Judges & Commissioners Association. Judge Oakley requested that the court begin thinking about whether or not that is a chapter the court would like to be a part of based on Burnet County's geographic location.

No action was taken.
             
Item #9:
Contracts, Agreements, Grants
  The court discussed contracts, agreements or grants to be approved and/or ratified:

Karen Hardin, County Services Director, presented the Texas Community Development Block Grant Program Disaster Relief Application, the Pre-Agreement Request, the LESO Contract for Constable 4 which was ratified, the Sydaptic Agreement, the VOTEC Contract, the Stitch Marketing Agreement, and the Waste Management Consent to Assignment Amendment. The Consent to Assignment was amended to update the host benefit fee to a flat fee of $1,000.00 per month paid to Waste Management of Texas, Inc. as opposed to the previously stated $0.50 per cubic yard paid to BFI Transfer Systems of Texas, LP.
James Oakley, County Judge, also presented a Proposal from 4/S Enterprise for the repairs needed for the Recycle Building in the amount of $34, 3000.00. These funds would come from the 2019 Tax Note Series.
  Motion was made by Commissioner Precinct 4 Joe Don Dockery, Seconded by: Commissioner Precinct 1 Jim Luther, Jr. to approve all contracts, agreements or grants to be approved and/or ratified.

Carole Poppema, Assistant County Auditor, stated that Paving Rock and Paving Oil bids will be opened on Tuesday, 2/12/2019.
