County of  Burnet        {}             On this the 5th day of November, 2018, the Burnet County Commissioners Court met in Special Session.  The following members of the court were present:

County Judge James Oakley; Commissioner Precinct 1 Jim Luther, Jr.; Commissioner Precinct 2 Russell Graeter; Commissioner Precinct 3 Billy Wall; Commissioner Precinct 4 Joe Don Dockery

Agenda
  1.  Call to Order
 
2.  Public Comments.  Any person with business before the Commissioner’s Court not scheduled on the agenda may speak to the Court.  No formal action can be taken on these items at this meeting. Comments regarding specific agenda items should occur when the item is called. There is a 2 minute speaking limit. 
 
3. Discussion and/or action regarding any items deemed necessary and relevant to the recent flooding
 
4.  Executive Session.  Discussion with Burnet County Commissioner’s Court and the County Civil Attorney(s) and/or the County Attorney in accordance with Texas Government Codes 551.071.  The Commissioners Court reserves the right to adjourn into Executive Session at any time during the course of this meeting to discuss any matters as authorized by the Texas Government Code including, but not limited to, Sections:  551/071 (Consultation with Attorney), 551.072 (Deliberations about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices), 551.087 (Economic Development), 418.183 (Deliberations about Homeland Security Issues), 551.0725 (Contracts being negotiated).

Call to Order
  Judge Oakley called the meeting to order at 9:00 a.m.
             
Item #2:
Comments
  No public comments were made.

Judge Oakley stated L.C.R.A. will lower Lake L.B.J. four feet and Lake Marble Falls seven feet starting December 30, 2018. The Lakes will be refilled February 23, 2019.
             
Item#3:
Flooding
  The court discussed any items deemed necessary and relevant to the recent flooding.

Judge Oakley reported L.C.R.A. has donated $100,000.00 to each Burnet and Llano Counties to assist in the cleanup of waterways for public safety.

Motion was made by Commissioner Precinct 2 Russell Graeter, Seconded by Commissioner Precinct 1 Jim Luther, Jr., to approve the acceptance of a $100,000.00 donation from L.C.R.A.

Vote: 5 - 0 Passed - Unanimous

Commissioner Precinct 4 Joe Don Dockery would like to publicize this information to address areas in coves along the lakes.

Commissioner Precinct 4 Joe Don Dockery would like to see if there are more grants available for cleanup assistance and debris removal.

Commissioner Precinct 1 Jim Luther, Jr. stated as of Friday roadside pickup has ceased and the roadways have been cleared.

Judge Oakley thanked the Commissioners for all their hard work with cleanup efforts.

Item #7:
Region K Water Planning Group
  The court discussed the appointment of Commissioner Joe Don Dockery to Region K Water Planning Group.
  Motion was made by County Judge James Oakley, Seconded by: Commissioner Precinct 1 Jim Luther, Jr. to approve the appointment of Commissioner Joe Don Dockery to the Region K Water Planning Group.
  Vote: 5 - 0 - Unanimously

Contracts, Agreements or Grants
  The court discussed contracts, agreements or grants to be approved and/or ratified.

Carole Poppema, Assistant County Auditor, added a contract with Condor Document Services for on-site shredding in the amount of $60.00 a month.
  Motion was made by Commissioner Precinct 4 Joe Don Dockery, Seconded by: Commissioner Precinct 1 Jim Luther, Jr. to approve a contract with Condor Document Services in the amount of $60.00 a month.

Item #9:
Call for Bids/Requests for Proposals/Qualifications
  The court discussed a Call for Bids/Requests for Proposals/Qualifications. Discussion and/or action on bid/RFP openings or submitted bids.

Karen Hardin, County Services Director, stated the following bids were recieved for the HHW Contract:
Green Planet  - $751.00
K-5                 - $375.40
Stericycle       - $800.00

Karen Hardin, County Services Director, stated the recommendation is to award the bid to K-5.

Motion was made by Commissioner Precinct 3 Billy Wall, Seconded by Commissioner Precinct 2 Russell Greater to award the contract to K-5 and authorize Judge Oakley to sign the agreement upon approval from the County Attorney.

Vote: 5 - 0 Passed - Unanimously 

Commissioner Precinct 3 Billy Wall amended the motion to include the FEMA review of our processes. Commissioner Precinct 2 Russell Graeter seconded the amended motion. The motion passed.

  The court reconvened at 10:18 a.m. with all members present.
             
Item #9:
Call for Bids/Requests for Proposals/Qualifications
  The court discussed a Call for Bids/Requests for Proposals/Qualifications.

Judge Oakley stated the court received the following bids for debris removal:
Central Texas Waste & Recycling - $38.90
DRC Emergency Services             - $36.15
J-Bar                                              - $29.64
Republic Services                          - $28.00
TDS                                                - $14.25
TFR                                                - $37.06

Herb Darling, Environmental Services Director, stated the recommendation is to award the bid to TDS, but to not to sign the agreement until we receive approval from FEMA.

Motion was made by Commissioner Precinct 1 Jim Luther, Jr., Seconded by Commissioner Precinct 3 Billy Wall to award the bid to TDS, subject to approval from the County Attorney and FEMA. This motion also authorizes the County Judge to sign the contract after approval.
 
Vote: 5 - 0 Passed - Unanimously

Karen Hardin, County Services Director, stated no bids were received for refrigerant removal proposals.

Herb Darling, Environmental Services Director, stated the County will prepare a new RFP for refrigerant removal.

Motion was made by Commissioner Precinct 4 Joe Don Dockery, Seconded by Commissioner Precinct 1 Jim Luther, Jr., to call for an RFP for refrigerant removal.

Vote: 5 - 0 Passed - Unanimously

Item #3:

Herb Darling, Environmental Services Director, presented the MOU for the oral agreement made with the City of Granite Shoals.
  Motion was made by Commissioner Precinct 1 Jim Luther, Jr., Seconded by: Commissioner Precinct 2 Russell Graeter to approve the MOU with the City of Granite Shoals.

Item #4:
Executive Session

Item #6:
Items Discussed in Executive Session
  The court discussed items discussed in Executive Session and take up for consideration and possible action, pursuant to Chapter 262, Texas Local Government Code. 

This item is open in conjunction with Item #9 - Call for Bids/Requests for Proposals/Qualifications.

Judge Oakley stated the following bids were received for the Jail Security System:
CML                                                 - $897,750 for the base system
Montgomery Technology Solutions - $532,000 for the system
Sustainable Security Solutions         - $402,137.00 for the system
Sydaptic                                            - $741, 705.16 for the base system

Judge Oakley stated the RFP was not written specific enough and will reject these bids and resubmit a more specific RFP.

Motion was made by Commissioner Precinct 4 Joe Don Dockery, Seconded by Commissioner Precinct 1 Jim Luther, Jr., to reject all bids.

Vote: 5 - 0 Passed - Unanimously

Judge Oakley asked for a motion to go back out for bids for a new Jail Security System.

Motion was made by Commissioner Precinct 4 Joe Don Dockery, Seconded by Commissioner Precinct 1 Jim Luther, Jr., to call for RFPs for a new Jail Security System.

Vote: 5 - 0 Passed - Unanimously

Judge Oakley thanked Herb Darling for all his hard work during and after the flooding event.
