DSA-17-00063 - Request by Sam Clegg for property located at 1205 E. Sunset Drive:       
     a. Variance to allow a second driveway whereas City Code Section 17.56.100 limits single family uses to one drive access per property.  (Planner Laura Blakeman)

In August 30, 2016, the property owners received a code violation for parking their blue Chevy S10 in the front yard. 
On September 13, 2016, the owner’s removed the car out of the front yard and the code enforcement violation was closed.
In April of this year, the owners contacted city staff to inquire about having a second driveway. The owners have five vehicles, with one parked in the garage, three parked on the existing driveway and one vehicle that needs to be parked preferably on the property. The owners stated that they would like to pour two concrete strips (2’ x 20’) for a secondary driveway along the east side of the property to park one of their vehicles.  The owners have stated that they do not like to park along the street, as there is a lot of drivers that use Sunset Drive and there have been a couple of hit and run accidents. 
According to City Code section 17.56.100, single family uses are limited to one drive access per property, unless approval is granted by the Planning and Zoning Commission:
 17.56.100  Drive access—Number required.
Each property shall be allowed at least one drive access for each one hundred feet of street frontage. Single-family uses shall be limited to one drive access per property. These conditions shall apply unless otherwise granted approval by the planning and zoning commission.
According to City Code section 8.12.050, the improved parking area cannot exceed a maximum of fifty percent of the combined front yard area:
8.12.050 Parking in front or side yard
It shall be unlawful to park or store any motor vehicle, recreational vehicle, watercraft, or utility trailer within the front or corner side yard of a single or two-family dwelling, except a motor vehicle, other than a recreational vehicle, may be parked on an Improved Parking Area in the front or corner side yard provided that the Improved Parking Area does not exceed a maximum of fifty percent of the combined area of the front and corner side yard.
The owners submitted a site plan that shows the location of the proposed driveway, which consists of two concrete strips.  Based on the site plan, the owner would meet the code regarding the improved parking area.
Staff recommends the Planning Commission approve DSA-17-00063, to allow a second driveway location at 1205 E. Sunset Drive.
