Adopt amendments to Chapters 13.08 and 13.12 of Casa Grande City Code to include the adoption of the Casa Grande Pretreament Regulations.
Staff recommends the Mayor and City Council approve by Ordinance amendments to Chapters 13.08 and 13.12 of the Casa Grande City Code.
As required by the City of Casa Grande AZPDES (Arizona Pollution Discharge Elimination System) Permit issued by ADEQ, the City is required to update our local limits and pretreatment program to ensure compliance with Federal and State regulations, as well as maintaining operation capability and efficiency at the Water Reclamation Facility (WRF). The City’s current local limits were created and adopted in 2004. Since that time, regulations governing pollutants of concern have been revised, and the WRF has been expanded and improved. These changes necessitate revisions to our Local Limits to ensure our permitting and oversight of industry is in compliance with Federal requirements. This process requires that those portions of the City Code be updated and revised so they reflect the new limits and permit requirements. The intent of this action is therefore to provide these revisions by repealing the existing code sections, and replacing them with the updated revised sections. The Pretreatment Regulations, Local Limits Study, and Enforcement Response Plan were submitted to ADEQ in November of 2016 to update our permit on how the City will implement our Pretreatment Program. On December 1, 2016, ADEQ mailed a letter of intent to approve the Local Limits and Legal Authority Revisions. A 30-day Public Notice was published and ended on January 13, 2017. On January 18, 2017, ADEQ issued a letter of Approval of the City of Casa Grande Local Limits & Legal Authority Revisions. Per this letter, the City is required to implement its pretreatment program in accordance with its wastewater permit.
Because of the updates and changes to the Pretreatment Regulations, amendments to Casa Grande City Code Chapter 13.08 to update and remove a few of the definitions contained in that section are necessary. Additionally, we are amending Chapter 13.12 to adopt by reference the new Pretreatment Regulations.
There are no direct fiscal impacts anticipated by the city. Fees for review and inspection services of the Pretreatment program have not been updated in quite some time. With the assistance of our consultant, applicable fees, surcharges, and fines will be revised and/or established through the City of Casa Grande consolidated fee schedule process.
