SUBJECT
Public hearing and consideration of a request by Steve Scannell & Jodi Sartain for the following land use approval for property located at 2425 E Florence Blvd, a.k.a. the former Sam’s Club site within the Mission Royale Planned Area Development (PAD) zone:
 
a. DSA-19-00142:  Conditional Use Permit for Wal-Mart driver onboarding, to allow professional truck driver training for a limited period.  (Planner James Gagliardi)

DISCUSSION
The zoning of the property requires that a conditional use permit be sought for a business, technical, vocational school; which is the most similar to the requested use of driver training at this site. The proposed use is temporary in nature until a permanent facility is ready in another location.    
 
The staff report which contains embedded exhibits is Attachment 1.  It provides the details of the request as well as an overview of the critieria used to evaluate a conditional use permit as well as the conditional use permit resolution that will be recorded with Pinal County should this request be approved. 
 
RECOMMENDATION
Staff recommends that the Commission approve DSA-19-00142, a Conditional Use Permit for driver onboarding within the Mission Royale PAD and the associated Resolution DSA-19-00142, with the following specific conditions: 
 
  1. This use shall be deemed expired and cannot continue without the consideration of a new Conditional Use Permit after the period of 18 months from the date of the Planning Commission hearing considering this request. 
 
  1. No idling nor horn honking is permitted
 
  1. No daily truck departures nor reversing of trucks can occur prior to 7:00 a.m.
 
  1. This use shall operate according to the provided narrative and site plan associated with this Conditional Use Permit, DSA-19-00142, unless minimally modified with the approval of the Planning Department.
 
  1. The Applicant agrees to work with the Planning Department to make potentially minor adjustments to operations, if determined practical and to the satisfaction of the Planning Department, should it be demonstrated that an adverse impact is made known during the period of this Conditional Use Permit.
 
  1. All fire access lanes must remain clear of stationary vehicles and trailers at all times
 
  1. Existing building and property fire protection systems shall be inspected and maintained.  Applicant is to provide the latest inspection reports for the Fire Alarm system, Automatic Fire Suppression system, and Fire hydrants, if private.
